By accessing the Sumo Strength website, purchasing any product, or using our services, you agree to be bound by these Terms & Conditions. Please read them carefully. If you do not agree with any part of these Terms, you should not use this website.

These Terms & Conditions operate in conjunction with our Shipping & Delivery Policy, Returns & Refunds Policy, Warranty Policy, and Privacy Policy, all of which form part of the terms governing your purchase.

1. About Us

The Sumo Strength website (sumostrength.com.au) is operated by Aquilia Group Pty Ltd (“we”, “our”, “us”).

Throughout the site, “you” refers to customers, visitors, and users of our website.

We reserve the right to update, modify, or replace any part of these Terms by posting changes on this page. Continued use of the site after changes are posted constitutes acceptance of the updated Terms.

2. Online Store Terms

By using our website, you confirm that:

  • You are at least 18 years old or have permission from a parent/guardian.
  • You are purchasing products for lawful purposes only.
  • You will not misuse our website or products.

We may refuse or cancel orders at our discretion, including where:

  • A product becomes unavailable
  • Payment verification fails
  • Pricing or listing errors occur
  • Fraud or misuse is suspected

If payment has already been made, a full refund will be issued to the original payment method.

3. Ordering & Payment

Orders are processed once payment has been successfully received through one of the approved payment methods shown at checkout.

We may accept payments via:

  • Shopify Payments (which may be processed by Stripe)
  • Credit and debit cards
  • PayPal
  • Afterpay
  • Zip Pay
  • Other methods as offered from time to time

When you choose Afterpay or Zip Pay, your instalment schedule, approvals, and any fees (including late fees) are determined solely by the provider and are subject to their own terms and conditions. Sumo Strength has no control over their approval decisions or fee structures.

You agree to:

  • Provide accurate, current, and complete billing, shipping, and contact information
  • Update your details promptly if they change

We are not responsible for delays, failed deliveries, or payment issues caused by incorrect or incomplete information supplied by you.

4. Pricing, Availability & Modifications

All prices listed on our website are in Australian Dollars (AUD) and include GST where applicable.

We may:

  • Change prices without prior notice
  • Modify or discontinue products or services
  • Limit quantities available for purchase

We do not guarantee that all product descriptions, specifications, images, or pricing are error-free. Minor variations in colour, finish, or sizing may occur due to manufacturing and display differences.

If a pricing, listing, or availability error is identified, we may correct it and/or cancel any affected orders. If payment has been taken, a full refund will be issued.

5. Shipping, Delivery & Freight Handling

All deliveries are governed by our Shipping & Delivery Policy, which sets out:

  • Dispatch timeframes
  • Delivery estimates
  • Kerbside-only delivery conditions
  • Authority to leave
  • Tracking information
  • Customer responsibilities

By placing an order, you acknowledge and accept the delivery conditions outlined in the Shipping & Delivery Policy.

6. Returns, Refunds & 100-Day Home Trial

Our Returns & Refunds Policy and 100-Day Home Trial form part of these Terms.

Key points include:

  • Change-of-mind returns are subject to eligibility conditions, including time limits, product condition, and original packaging.
  • Our 100-Day Home Trial allows eligible equipment to be used and returned within the trial period, subject to reasonable wear, original packaging, and customer-covered return shipping.
  • Returns are not accepted for products that are damaged by misuse, incorrect assembly, modification, or improper storage.
  • Refunds are processed back to the original payment method once items have been inspected and approved.

Your rights under Australian Consumer Law apply in addition to our policies.

7. Warranty

Your purchase is covered by our Sumo Strength Warranty Policy, which outlines warranty durations for different product categories and whether they are used in home or commercial environments.

Warranty claims require:

  • Valid proof of purchase
  • Clear photos or videos of the fault
  • A description of the issue and usage conditions
  • Compliance with assembly, maintenance, and safe-use guidelines

The warranty does not cover:

  • Normal wear and tear
  • Cosmetic damage or surface rust
  • Misuse, overloading, or impact damage
  • Incorrect assembly or installation
  • Use outside intended purpose
  • Modifications or repairs carried out by unauthorised parties

Nothing in these Terms limits your rights under the Australian Consumer Law.

8. Product Installation, Assembly & Safety

Sumo Strength products include heavy weights, racks, rigs, machines, benches, and other training equipment. Safe assembly and use are critical.

By purchasing and using our products, you agree that:

  • You are responsible for following all assembly, installation, and safety instructions supplied with the products.
  • Equipment must be regularly inspected for loose bolts, worn parts, frayed cables, and other signs of wear or damage.
  • In commercial gyms and studios, owners and operators are responsible for implementing a regular inspection and maintenance schedule, and for supervising member use where appropriate.
  • Certain products must be anchored, bolted, or secured as specified for safe use.

Sumo Strength is not responsible for injury, property damage, or loss resulting from:

  • Improper assembly or installation
  • Misuse or unsafe operation
  • Failure to follow instructions, warnings, or maintenance guidelines

9. Third-Party Tools, Carriers & Links

We may provide access to third-party tools, shipping carriers, service providers, or external websites.

You acknowledge that:

  • These third parties operate independently of Sumo Strength.
  • We do not control or guarantee their performance, content, or policies.
  • Your use of third-party services and websites is at your own risk and subject to their own terms and privacy policies.

Any delay, loss, or damage caused by freight carriers or third-party providers is governed by their terms. We will, however, reasonably assist you in resolving delivery issues where possible.

10. Mobile Messaging (SMS) Terms

If you provide your mobile number at checkout or opt into SMS communications, you consent to receive:

  • Order updates
  • Delivery notifications
  • Service-related messages
  • Marketing messages where you have opted in

You can opt out at any time by replying STOP, following the unsubscribe instructions in the message, or emailing sumostrength@aquilia.com.au. Transactional messages (such as essential order updates) may still be sent where required to fulfil your purchase.

Standard carrier rates may apply. Sumo Strength is not responsible for delays or delivery failures caused by mobile networks.

11. Limitation of Liability

To the fullest extent permitted by law, Sumo Strength and its directors, employees, and agents are not liable for:

  • Indirect, incidental, or consequential losses or damages
  • Loss of profits, revenue, or data
  • Injury or damage arising from improper assembly, misuse, or failure to follow safety instructions
  • Loss or damage arising from delays or failures by third-party carriers or service providers
  • Losses arising from errors or omissions in product descriptions, pricing, or availability

Where liability cannot be excluded, it is limited, at our option, to:

  • Repair or replacement of the goods
  • Resupply of equivalent goods
  • Payment of the cost of repair, replacement, or resupply

Nothing in these Terms excludes or limits rights and remedies you may have under the Australian Consumer Law.

12. Intellectual Property

All content on this website, including but not limited to text, images, product descriptions, logos, icons, graphics, and branding, is owned by Sumo Strength or its licensors.

You may not copy, reproduce, distribute, modify, or use any content for commercial purposes without our prior written permission.

13. Indemnity

You agree to indemnify and hold harmless Sumo Strength, its directors, employees, agents, and affiliates from any claim, demand, loss, or damage arising out of:

  • Your breach of these Terms
  • Your misuse of the website or products
  • Your violation of any law or third-party rights
  • Injury or damage caused by improper installation or unsafe use of our products

14. Termination

We may suspend or terminate your access to our website or services at any time, without notice, if we reasonably believe you have:

  • Breached these Terms
  • Engaged in fraudulent or abusive activity
  • Misused our products or intellectual property

Any obligations and liabilities incurred prior to termination will survive termination of this agreement.

15. Severability

If any part of these Terms is found to be unlawful, void, or unenforceable, that part will be deemed severed from the Terms. The remaining provisions will continue in full force and effect.

16. Governing Law

These Terms & Conditions are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
